• In the next in our series of blogs covering an employer’s obligations under GDPR, we look at whether employers can share employee data between group companies and abroad.
  • In short, the answer is yes. If you have the legal basis for the processing, it is possible to share data between group companies and abroad.  As an example, there may be shared payroll functions in which the sharing of data is necessary to ensure compliance with your legal and contractual obligations to pay your employees.
  • With regards to sharing data abroad, you will need to ensure the data will receive the same protection once it is received by the receiver. This will likely be the case for most companies in the EU, as they will also be bound by GDPR. However, for countries outside of the EU, you will need to ensure an equivalent level of data protection is in place.
